Man accused of poisoning of charged Auburn trees

OPELIKA, Ala.-A grand jury indicted the man accused of poisoning Toomer of Auburn corner oak, where fans have long celebrated great victories, and hundreds gather after the Tigers of the national football championships won on 10 January.


Harvey Updyke Jr., 62, was charged with four counts of criminal charges and two offences by a grand jury of Lee County. He faces two counts of felony criminal mischief, first degree two counts of felony for illegal damage, vandalism or theft of property from a facility of farm animal cultures and two counts of offence to desecrate a revered object, according to court documents.


Updyke is scheduled for arraignment on 26 May, before the judge of the Court of the County of Lee Jacob a. Walker III Circuit. It has a tentative trial date of June 20.


Updyke Attorney, Glennon Threatt Jr., did not immediately return calls seeking comment Wednesday.


If convicted, Updyke are liable for up to 10 years in prison for each count of criminal charges and that a sentence of one year and $2,000 fine on the tort.


The century-old trees President Toomer's corner, at the intersection of the campus and downtown. One of the traditional celebrations was heaving of toilet paper in the branches.


Updyke said that he was attacked by strangers at a gas station shortly after leaving the courthouse of its appearance to a preliminary hearing, on which he gave to the suite.


Captain of Police Opelika Allan Elkins said Wednesday no suspects were found or arrested.


"There is no activity in this case since the report was made," said Elkins. "No there were no witnesses to come forward, no there was no evidence collected. Investigators have nothing to work with. ?


Updyke gave what was equivalent to an admission of intoxication no later in the evening on a radio show in Birmingham, saying: he did not wish that his legacy as "Harvey the poisoner tree." He also said that "no doubt" is one of the good things he did in his life.


He completed his appearance by saying, "Damn Roll tide."


"All my life, people told me that I was much too much of Alabama," Updyke said on the show.
